An overview of all published EU legislation which is the basis for the use of a drone or drone training in the open and specific category.

EU Regulation 2021/1166

Commission Implementing Regulation (EU) 2021/1166 of 15 July 2021 amending Implementing Regulation (EU) 2019/947 as regards postponing the date of application for standard scenarios for operations executed in or beyond the visual line of sight. You can read and download it HERE.

The European STS can be declared to the NAA (National Aviation Authority) from December 3, 2023. The original date (December 2021) has been postponed by two years.

EU Regulations 2021/664, 665 and 666

Commission Implementing Regulation (EU) 2021/664 of 22 April 2021 on a regulatory framework for the U-space. You can read and download it HERE.

Commission Implementing Regulation (EU) 2021/665 of 22 April 2021 amending Implementing Regulation (EU) 2017/373 as regards requirements for providers of air traffic management/air navigation services and other air traffic management network functions in the U-space airspace designated in controlled airspace. You can read and download it HERE.

Commission Implementing Regulation (EU) 2021/666 of 22 April 2021 amending Regulation (EU) No 923/2012 as regards requirements for manned aviation operating in U-space airspace. You can read and download it HERE.

These regulations are intended for in particular the certified category and especially to establish U-Space. This is a new airspace class in which, for instance, manned UAS flights will take place in the future.

EU Regulation 2020/1058

Commission Delegated Regulation (EU) 2020/1058 of 27 April 2020 amending Delegated Regulation (EU) 2019/945 as regards the introduction of two new unmanned aircraft systems classes.

This Regulation introduces the technical requirements for C5 and C6 labels, that are compulsory for STS (in the specific category). You can read or download it HERE.

EU Regulation 2020/746

Commission Implementing Regulation (EU) 2020/746 of 4 June 2020 amending Implementing Regulation (EU) 2019/947 as regards postponing dates of application of certain measures in the context of the COVID-19 pandemic. You can read or download it HERE.

This Regulation regulates the postponement of the introduction of the EU drone regulation (EU 2019 945/947). You will find these regulations in brief below.

EU Regulation 2020/639

Commission Implementing Regulation (EU) 2020/639 of 12 May 2020 amending Implementing Regulation (EU) 2019/947 as regards standard scenarios for operations executed in or beyond the visual line of sight. You can read or download it HERE.

In this regulation, the first two European standard scenarios are introduced: flying on sight in populated, residential areas (STS-01) and flying out of sight in sparsely populated areas (STS-02). There are requirements for the operator, the aircraft and the pilot. An STS can be declared to the NAA.

EU Regulation 2019/947

Commission Implementing Regulation (EU) 2019/947 of 24 May 2019 on the rules and procedures for the operation of unmanned aircraft. You can read or download it HERE.

In this regulation, the frameworks are formulated for operations in the open, specific and certified category. The current legacy drones, which do not have a Cx label, fall into the limited open category: From December 31 2020, you must keep a distance of 50 meters from uninvolved persons in subcategory A2 and from 1 January 2023, you can only fly, from 250 grams, in subcategory A3.

EU Regulation 2019/945

Commission Delegated Regulation (EU) 2019/945 of 12 March 2019 on unmanned aircraft systems and on third-country operators of unmanned aircraft systems. You can read or download it HERE.

In this regulation Cx labels (C0, C1, C2, C3 and C4) have been introduced. A Cx label contains technical requirements and limitations for manufactured unmanned aircraft. As standards have not yet been adopted in the EU, manufacturers are not able to comply till likely fall 2022.

EASA Easy Access Rules for Unmanned Aircraft Systems

Easy Access Rules for Unmanned Aircraft Systems (Regulation (EU) 2019/947 and Regulation (EU) 2019/945) Revision from September 2021. You can find it HERE.

This publication contains the rules and procedures for the operation of unmanned aircraft, displayed in a consolidated, easy-to-read format, with advanced navigation features through links and bookmarks.

It covers Commission Implementing Regulation (EU) 2019/947, and the related acceptable means of compliance (AMC) and guidance material (GM), as well as Commission Delegated Regulation (EU) 2019/945 on unmanned aircraft systems (UAS) and on third-country operators of UAS.

This Revision from September 2021 incorporates the changes introduced by Commission Implementing Regulation (EU) 2021/1166 amending Commission Implementing Regulation (EU) 2019/947 as regards postponing the date of application for standard scenarios.

The Revision is also available as dynamic online publication with filters for obtaining the regulatory material tailored to one’s needs, search functions for quickly accessing the relevant sections, and easy navigation for computers, tablets, and mobiles.

The document will be updated regularly to incorporate further changes and evolutions to the implementing regulations (IRs), delegated regulations (DRs), AMC, and GM.

National legislation

EASA member states are still able to establish local geographic zones to restrict UAS traffic. Furthermore, state actors (government-affiliated organizations) are allowed to fly state aircraft under existing national legislation.
